1. Agreement to Terms
ERgent (the "App") is provided by Titanite Group LLC ("Company," "we," "us," or "our"), operated by its developer, Abraham Salazar. These Terms of Service ("Terms") govern your access to and use of the App. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Your use of the App is also governed by Apple's Standard End User License Agreement (EULA). If there is a conflict between these Terms and Apple's Standard EULA regarding the software license itself, Apple's Standard EULA controls; these Terms govern all other aspects of your use of the App, including the service we provide, subscriptions, and the disclaimers below.
2. Description of the App
ERgent helps you quickly locate the nearest emergency room (ER) based on your current location, using your device's location services and map/address data. Once a facility is identified, ERgent hands off navigation to the third-party maps or navigation app of your choice — ERgent does not provide in-app turn-by-turn directions.
ERgent's coverage is currently limited to select Southern California counties, including Los Angeles, Ventura, and Orange. We are working to expand coverage over time, and our facility database is incomplete and updated incrementally. Availability, accuracy, and completeness of results will vary by location.
3. Not a Substitute for Emergency Services — Please Read Carefully
ERgent is a location tool, not an emergency response, medical, or dispatch service. In a medical emergency, always call 911 (or your local emergency number) immediately — do not rely on ERgent instead of, or before, calling for emergency help.
ERgent does not provide medical advice, diagnosis, or treatment, and nothing in the App should be treated as such. ERgent is designed with emergency medical response personnel (EMTs, paramedics, and other first responders) in mind, but it is not restricted to professional users, and these disclaimers apply equally to everyone who uses it.
Facility information — including location, operating status, capacity, and services offered — is provided on an "as available" basis and may be outdated, incomplete, or inaccurate. We do not guarantee that any facility identified by the App is open, reachable, or able to treat a given condition at the time you arrive. Always use independent judgment and verify critical information when time and circumstances allow.
4. Eligibility
You must be at least 18 years old to use the App. By using the App, you represent that you meet this requirement.
5. No Account Required; Location Data
ERgent does not require you to create an account or log in, and it does not display third-party advertisements. The App uses your device's current location and map/address data solely to identify and display nearby emergency rooms. We do not collect, sell, or profit from your personal data beyond what is necessary for the App to function. For more detail, see our Privacy Policy.
6. Subscriptions
Full use of the App requires an active, paid subscription, verified when the App launches. We currently offer:
- Monthly — $4.99/month
- Annual — $49.99/year (approximately 16.5% off the monthly rate)
Subscriptions are billed through your Apple ID / App Store account and automatically renew for the same length and price unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription, and turn off auto-renewal, anytime in your device's Account Settings, and you can restore a previous purchase from within the App.
We may offer promotional or discount codes from time to time; these are subject to their own terms and are provided at our discretion. Refunds are handled by Apple in accordance with Apple's own policies — we are not able to issue refunds directly.
7. Intellectual Property
The App, including its name, logo, design, and underlying software, is owned by the Company or its licensors and is protected by intellectual property laws. Apple's Standard EULA governs the license granted to you to use the App; these Terms do not grant you any additional rights in the App, its content, or our trademarks.
8. Acceptable Use
You agree not to: reverse-engineer, decompile, or attempt to extract the source code of the App except as permitted by law; use the App for any unlawful purpose; interfere with or disrupt the App or its underlying infrastructure; or use the App in any way inconsistent with these Terms, including as a substitute for professional emergency response.
9. Third-Party Services
ERgent hands off navigation to third-party maps and navigation apps of your choosing, and may rely on third-party data providers for facility and location information. We are not responsible for the availability, accuracy, content, or practices of any third-party app or service, and your use of them is governed by their own terms.
10. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT FACILITY OR LOCATION INFORMATION WILL BE ACCURATE, COMPLETE, OR CURRENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY, ITS DEVELOPER, AND THEIR RESPECTIVE AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, HEALTH OUTCOMES, OR OTHER DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP — INCLUDING ANY DELAY IN OR FAILURE TO OBTAIN EMERGENCY CARE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO SOME OF THEM MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify and hold the Company and its developer harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the App or violation of these Terms.
13. Termination
We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and cancel your subscription at any time through your Apple ID Account Settings.
14. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted, with an updated "Last Updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any disputes arising from these Terms or the App will be subject to the exclusive jurisdiction of the state and federal courts located in California.
16. Severability & Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy and Apple's Standard EULA, constitute the entire agreement between you and the Company regarding the App.
